The name of an Australian man was written in the child’s birth certificate born to a lesbian couple.  He donated sperm to the couple. Court has ordered to remove his name from child’s birth certification. The couple split in 2006 but according to court the former partner (lesbian) of the mother has right to have her name on the certificate. Court also denied any contractual right for claiming his name on certificate. The 58-year-old man is very unhappy and said it was “a very bad day for fathers”. He is devastated by the ruling. He had helped the lesbian couple after a newspaper advertisement by them to help in conceiving.  A baby girl was born in 2001.

He said, “She’s not my daughter as far as the law is concerned. The laws are totally inadequate, there are no laws to protect people like me.”

‘Considerable sympathy’

It is first time in the history of Australia when name of a sperm donor has been forcibly removed from the official document.

The mother is happy. She said before that her name on the birth certificate will help to avoid “confusion with schools, hospitals and government departments”.

Judge Stephen Walmsley said, “As (the sperm donor) concedes, there was no agreement before the birth that he would be on the register when he agreed to donate his sperm.

“I have considerable sympathy for (the man) – he has done what he considers has been his very best for the child,” the judge said.

However according to the judge, under Australian law sperm honor has parental rights.

Justice Soumitra Sen

First time in the history of independent India a Judge will be impeached in India. A voting was conducted electronically with the permission of Rajya Sabha Chairman Hamid Ansari. A total of 189 members out of 207 were in favor of impeachment compared to 17 against it. One member abstained voting.

Communist Party of India-Marxist member Sitaram Yechury had moved the motion against Justice Soumitra Sen of the Calcutta High Court on Wednesday. He said that this motion is against an individual judge and not against the institution of judiciary itself. Justice Sen  is accused of misconduct and charges of financial irregularities which include a Rs 24 lack deal in the 1990s. Sen defended by saying that, “I am defending my life, very existence. Please decide in accordance with your conscience, applying your mind and on merit.”

According to the law impeachment motion has to be passed through the two houses of parliament – Rajya Sabha and Lok Sabha. Now motion will be sent to Lok Sabha for approval within a week. Once its approved by both the houses of parliament in the same session, the motion would be sent to president of India Pratibha Patil for further action and removal of judge.

Justice V Ramaswami of the Supreme Court was first Indian Judge against whom impeachment motion was voted but it failed as that time ruling Congress abstained the motion in Lok Sabha.
